On the one hand, it is a brake on the fullness of the power of management and direction because, it is a determinant of the validity of hiring. The waiver of this right by the employee has no effect on the invalidity of his commitment whenever the performance is contrary to dignity. In addition, it is a referent both in fixing and in the payment of wages.On the other hand, dignity is an obstacle to the effective manifestation of regulatory and disciplinary powers. Indeed, it is both the basis for determining the nature and qualification of the disciplinary sanction and that of the requirement of decent work. In view of this, the judge can favor it, independently of any other subjective right, to condemn the employer in the event of abuse.
