Estado de la Transparencia es la instauración paulatina global del concepto de transparencia y del derecho de acceso, anclado constitucionalmente como fundamental, instaurados en los tres poderes del del Estado democrático español como consecuencia de la Gran Recesión del 2008 y a través de la Ley 19/ 2013, de 9 de diciembre de Transparencia, Acceso a la Información y Buen Gobierno, la cual se analiza jurídicamente. Así, se expone como es la extendida estructura legislativa de transparencia la cual plantea y sugiere el reconocimiento constitucional de este como derecho fundamental emergente y no el derecho constitucionalmente reconocido el origen del que se despliega la estructura de tal derecho. Para ello se realiza un estudio de derecho comparado, una revisión bibliográfica y una clasificación de antecedentes y de posiciones doctrinales junto con un conjunto de elementos prácticos actuales con el objetivo de ofrecer una panorámica general del estado actual de la transparencia, propuestas de mejora y reflexiones de implementación.

State of Transparency is the gradual global establishment of the concept of transparency and the right of access, anchored constitutionally as fundamental, established in the three branches of the Spanish democratic state as a result of the Great Recession of 2008 and through Law 19/2013, of December 9 of Transparency, Access to Information and Good Government, which is analyzed legally. Thus, it is exposed how is the extended legislative structure of transparency which raises and suggests the constitutional recognition of this as an emerging fundamental right and not the constitutionally recognized right the origin from which the structure of that right unfolds. To this end, a comparative law study, a bibliographic review and a classification of background and doctrinal positions are carried out together with a set of current practical elements with the aim of offering a general overview of the current state of transparency, proposals for improvement and reflections of implementation
