[ES] Este trabajo de investigación estudia una parcela de la institución jurídica de la responsabilidad civil en contacto con un colectivo de la sociedad caracterizado por su vulnerabilidad: la responsabilidad civil por hecho propio del menor de edad y del incapaz derivada de un ilícito civil como penal; la cual no ha sido objeto de atención por la doctrina española en los últimos años (habiéndolo sido solamente la de sus guardadores), aunque sí por la europea y anglosajona. Se ha tratado sólo el presupuesto del “criterio de imputación”, al ser la razón de justicia que justifica que la obligación indemnizatoria se impute a una persona, y por el hecho de que históricamente se les haya negado, sobre todo al incapaz, la posibilidad de incurrir en culpa civil, la regla general ex artículo 1902 Código civil español.En definitiva, el reto de este estudio, con cierta finalidad comparativa y enmarcado en el Derecho civil cuya vocación es la protección de la persona, se deriva de la escasa atención que ha rodeado el tratamiento jurídico de la incapacidad, pues de modo tradicional se ha legislado para el menor y, como si fuese un incapaz- tipo, dicha normativa se ha trasladado al resto de incapacidades.

[EN]This research explores a part of the legal institution of civil responsibility related to a group of society characterized by its vulnerability: civil liability of the minor and the disabled person, derived from an illicit, both civil and criminal; which has not been a matter of interest by the Spanish doctrine till now (having been only that of their guardians), unlike the European and Anglo-Saxon doctrine. This study deals exclusively with the "imputation criterion", given that it is the reason of Justice that justifies that a person has to pay a compensation, and due to the fact that historically it has been denied mainly to the disabled person, the possibility of incurring civil fault, the general rule ex Article 1902 Spanish civil code. Ultimately, the challenge of this study, with comparative purposes and framed within the Civil law whose vocation is the protection of the person, is derived from the scant attention that has surrounded the legal treatment of the disability, because, traditionally, legislation has been created for the minor, and, as an incapable - type, such legislation has moved to other disabilities
